Warning: The following contains SPOILERS for Batwoman's season 2 finale.
Kate Kane's plans following the finale of Batwoman season 2 accidentally revealed a rather large plot hole regarding Kate Kane's legal status and the final fate of her father, Jacob Kane. With Dougray Scott and Wallis Day not returning for Batwoman season 3, it's not surprising that the show's writers might not have felt the need to devote that much time to them, relative to the rest of the ensemble. Nevertheless, it is odd that the finale never revealed whether or not Jacob Kane had been released from prison in the wake of his arrest by GD police officers in the employ of Black Mask or whether or not Kate Kane was still considered legally dead.
Kate Kane spent most of the second half of Batwoman season 2 in a brainwashed state, having been hypnotized to think that she was Circe Sionis, the daughter of makeup magnate Roman Sionis. The Season 2 finale saw Kate Kane finally break free of her conditioning, ironically thanks to the Snakebite drug which fueled Sionis' rise to power as the crime boss Black Mask. Back to her old self, Kate officially ed the mantle of Batwoman on to Ryan Wilder, after telling her sister Mary and Luke Fox of her plans for the future, which were, in order, to "see my dad and then a friend in National City. Then I'm off to find Bruce."
Sending Kate Kane on a quest to find the missing Batman is Black Mask was pulling the strings against him. This was likely a clever way of keeping Jacob's character out of action, since it was unclear at the time the episode was filmed if Dougray Scott would be signed to be in Batwoman season 3.
Sadly, it can't be presumed that Jacob Kane was released from prison in the wake of Roman Sionis' plans being exposed to the world. While Jacob was nominally arrested under false pretenses, he was honestly guilty of the crime for which he was charged, having been in the middle of helping Alice (a wanted fugitive) with her plan to kidnap Kate Kane from the Sionis estate and try to restore her memory. Beyond that, it's possible Jacob would insist on staying in prison until he was officially cleared in court, feeling he deserved to be punished for the way he had treated his daughters or for his negligence leading to Crows Security violating the civil rights of countless innocent people.
Presuming Jacob was still in prison, it would be difficult for Kate to visit him, given that the world at large still thinks that Kate Kane is dead. While it's possible Kate could sneak into a prison in disguise to let her father know she was okay in person, it's highly unlikely. Even if Jacob had been quietly released from prison within the day after Roman Sionis' plans were revealed, Kate still had to work around the fact that she's legally dead and now has the face of a different woman. While Kate Kane is clever enough and rich enough to work around these obstacles, the final episode of Batwoman season 2 still dropped the ball in not clarifying these issues.
